اسلام آباد ہائیکورٹ سے سابق صدرآصف علی زرداری اوروفاقی وزیرفواد چوہدری کوبڑا ریلیف مل گیا۔ دونوں کو نااہل قراردینے کی درخواستیں مسترد کردی گئیں۔
اسلام آباد ہائیکورٹ کے چیف جسٹس اطہرمن اللہ نے نااہلی کی درخواستوں پر تحریری فیصلہ جاری کردیا۔ تحریری عدالتی فیصلے کے مطابق سیاسی معاملات عدلیہ کی مداخلت کے بغیر حل کیے جانے چاہیئں ۔عدلیہ کی جانب سے منتخب نمائندوں کو نااہل قرار دیا جانا انصاف کے منافی ہوگا ۔
اس سے پہلے اسلام آباد ہائی کورٹ نے سابق صدرآصف زرداری اوروفاقی وزیراطلاعات فواد چوہدری کونااہل قراردینے کی درخواستیں مسترد کرتے ہوئے قررا دیا۔ 2لاکھ ووٹرز کسی کومنتخب کریں تو غیرمنتخب جج کیوں نااہل قراردے۔
اسلام آباد ہائی کورٹ کے فیصلے کے مطابق 2 لاکھ ووٹرز کسی کو منتخب کریں تو غیر منتخب جج کیوں اسے نااہل قرار دے۔ سیاسی جماعتیں اپنے سیاسی تنازعات عدالتوں سے باہر نمٹائیں ۔ مفاد عامہ میں عدالتوں کو منتخب نمائندوں کی نااہلی کے کیسز میں پڑنا ہی نہیں چاہیے۔
اسلام آباد ہائیکورٹ نے استفسارکیا کہ کسی بھی منتخب نمائندے کو نااہل کرنے کے لیے عدالت کو کیوں کیس سننا چاہیے؟ یہ عدالت اس معاملے میں اپنا اختیار استعمال کرنے سے گریز کرتی ہے ۔ درخواستیں خارج ہونے کا تفصیلی فیصلہ بعد میں جاری کیا جائے گا۔
چیف جسٹس اسلام آباد ہائیکورٹ چیف جسٹس اطہرمن اللہ نے نااہلی کی درخواستوں کی سماعت کے دوران ریمارکس دیئے کہ دونوں کیسز منتخب نمائندوں سے متعلق ہیں۔دونوں کو عوام نے منتخب کیا ہے۔
چیف جسٹس اطہرمن اللہ نے ریمارکس میں کہا کہ ہر سیاسی جماعت نے اپنی سوشل میڈیا ٹرولنگ ٹیم رکھی ہے ۔ عدالتوں میں اپنےمعاملات لاتے ہیں۔ جس کیخلاف فیصلہ آئے وہ ٹرولنگ شروع کردیتا ہے۔
چیف جسٹس اسلام آباد ہائی کورٹ نے استفسارکیا کہ جب یہ سب ہونا ہے توعدالتیں ان معاملات میں کیوں پڑیں ۔ پھر آپ کہتے ہیں ہماری عدالتیں 139 ویں نمبرپرہیں ۔ یہ ریٹنگ عدالتوں کی نہیں پورے گورننس سسٹم کی ہوتی ہے۔اگر گورننس کے ایشو نہ ہوں تو عدالتوں میں کیس نہیں آئیں گے۔ عدالت نے سابق وزیر خارجہ کو نا اہل کیا تو 7ماہ تک ان کا حلقہ خالی رہا تھا۔ میں نہیں کہتا عدالتیں بہت اچھی ہیں لیکن پورا سسٹم دیکھیں ۔
