الیکشن کمیشن نے تحریک انصاف کے فیصل واوڈا کو دہری شہریت پر نااہل قرار دے دیا۔ چیف الیکشن کمشنر کی سربراہی میں 3رکنی کمیشن نے فیصلہ اوپن کورٹ میں سنایا۔
الیکشن کمیشن آف پاکستان نے 10 مارچ کو فیصل واوڈا کے بطور سینیٹر انتخاب کا نوٹیفکیشن واپس لے لیا۔ دو ماہ میں قومی اسمبلی کی تنخواہیں اور مراعات واپس کرنے کا حکم دے دیا ہے۔
الیکشن کمیشن کے مطابق فیصل واوڈا نے ریٹرنگ افسر کو جھوٹا بیان حلفی جمع کرایا ۔ بطور رکن قومی اسمبلی سینیٹ الیکشن میں دیا گیا ووٹ بھی غلط کاسٹ کیا گیا۔
الیکشن کمیشن کےفیصلے کے مطابق فیصل واوڈا سپریم کورٹ سے رجوع کر سکتے ہیں۔
پیپلزپارٹی کے قادرمندوخیل نے الیکشن کمیشن کے فیصلے کو خوش آئند اور پارٹی کی جیت قرار دے دیا ہے۔ الیکشن کمیشن کے باہر میڈیا سے گفتگو میں قادر مندوخیل نے کہا کہ 3سال عدالتوں کے چکر لگاتے رہے ۔ یہ پارٹی قیادت کی جیت ہے،پیپلزپارٹی سینیٹ میں یہ نشست حاصل کرے گی۔
الیکشن کمیشن میں سابق وفاقی وزیر فیصل واوڈا کی نااہلی کی یہ درخواستیں 2 سال قبل 21 جنوری 2020 ءکو مخالف امیدوار عبدالقادر مندوخیل، میاں فیصل اور آصف محمود نے دائر کی گئی تھیں ۔ کیس کی سماعت کا باقاعدہ آغاز 3 فروری 2020 کو ہوا۔
الیکشن کمیشن میں سماعتوں کے دوران فیصل واوڈا نے بتایا کہ عام انتخابات کے وقت ریٹرننگ افسر کے سامنے پیش ہوا تو منسوخ شدہ امریکی پاسپورٹ دکھایا تھا جس پر کلیئرنس ملی. نادرا نے 29 مئی 2018 ء کو امریکی شہریت سیز کردی تھی۔
الیکشن کمیشن میں درخواست گزاروں نے سرٹیفکیٹ کی فوٹو کاپی جمع کرائی جس کے مطابق فیصل واوڈا نے 25 جون 2018 ء کو امریکی شہریت چھوڑی تاہم فیصل واوڈا نے اس کاپی کو تسلیم نہیں کیا ۔
الیکشن کمیشن نے فیصل واوڈا سے امریکی شہریت چھوڑنے کے سرٹیفکیٹ کا استفسار کیا تو ان کا کہنا تھا انہیں پاکستان یا امریکا کے قانونی پیپر ورک کا زیادہ علم نہیں۔
درخواست گزاروں نے الیکشن کمیشن سے استدعا کی کہ وہ خود امریکی سفارتخانے سے سرٹیفکیٹ کے لیے رابطہ کر لے ۔ الیکشن کمیشن نے یہ کہہ کر انکار کردیا تھا کہ یہ اس کا اختیار نہیں۔
فیصل واوڈا نے سینیٹر منتخب ہونے کے بعد یہ استدعا بھی کی کہ یہ درخواستیں اس وقت کی ہیں جب وہ ممبر قومی اسمبلی تھے، اب انہیں مسترد کیا جائے ۔ اسلام آباد ہائی کورٹ نے 6 دسمبر کو الیکشن کمیشن کی کارروائی روکنے کی درخواست مسترد کردی تھی۔
الیکشن کمیشن نے فیصل واوڈا نااہلی کیس کا فیصلہ 23 دسمبر کو محفوظ کیا آج سنایا گیا ہے، واوڈانااہلی کیس الیکشن کمیشن میں 22ماہ سےزائدزیرسماعت رہا۔
